Welcome to Goje.ai! These Terms of Service (“Terms”) explain how you can use the services provided by Goje.ai (“Goje.ai”, “we”, “us”, “our”). By using our services, you agree to these Terms, so please read them carefully.
1. Service Overview
Goje.ai provides AI-powered voice solutions, including:
- Handling inbound calls (e.g., customer inquiries).
- Outbound calling and engagement.
- Call logging, reporting, and data collection.
- Integrations with your existing systems where applicable.
We may update or enhance services over time.
2. Subscriptions and Renewal
- Services are provided on a subscription basis (6-month or 12-month terms) as agreed in writing.
- Subscriptions automatically renew for the same period unless you provide written notice at least 30 days before renewal.
3. Payments
Fees are payable in advance via invoice, direct debit, or card and are non-refundable.
Late Payment: If payment is overdue by more than 14 days, Goje.ai reserves the right to suspend services until the balance is cleared. If overdue by 60 days, Goje.ai reserves the right to invoice the remaining contract balance and pursue recovery, including reasonable legal or collection costs. Interest may accrue under applicable UK law.
Usage Limits & Overage Charges
Your subscription may include usage limits (such as call minutes). If you exceed these limits, additional charges at £0.55 per minute will apply. You are responsible for monitoring your usage and will be held liable to pay for any additional usage incurred.
4. Modification of Terms and Services
Goje.ai may update these Terms and Services, including the Privacy Policy and other policies, at any time. Where changes are material, we will provide at least 30 days’ notice. Continued use after such notice constitutes acceptance.
5. Prohibited Uses
When using Goje.ai, you must not engage in any activity that is illegal, abusive, or interferes with the service. This includes, but is not limited to:
General Prohibited Activities
- Criminal, fraudulent, or malicious activities.
- Harassment, threats, defamation, abusive, or discriminatory behavior.
- Intellectual property infringement.
- Sending unauthorized spam or unsolicited communications.
- Transmitting viruses, malware, or other harmful code.
- Collecting, storing, or sharing personal data without proper consent.
- Interfering with service functionality, security, or performance.
Telemarketing and Call Compliance Prohibited Activities
- Making calls without prior express consent or an established business relationship.
- Calling numbers on do-not-call lists or emergency services.
- Using Goje.ai for unlawful marketing, robocalls, or spam.
- Misrepresenting caller identity, falsifying or blocking Caller ID.
- Attempting to access other accounts, networks, or systems without authorisation.
- Using automated tools to access the service in ways not permitted by Goje.ai.
Enforcement and Consequences
- Goje.ai may suspend or terminate your account immediately if you violate these rules.
- We may co-operate with law enforcement or regulators regarding any suspected illegal or improper use, which may include disclosing your account and activity.
6. Client Responsibilities
You agree to:
- Provide accurate and lawful data in line with UK GDPR regulations.
- Obtain necessary consents for any personal data provided.
- Use the service in compliance with laws, including avoiding spam or unlawful content.
AI Outputs and Accuracy: Goje.ai uses artificial intelligence to generate responses, insights, and communications. While we aim for high accuracy, outputs may sometimes be incomplete or incorrect.
- You are responsible for reviewing and verifying all AI-generated outputs, including call interactions, transcripts, and reports, before relying on them for any decisions.
- Goje.ai shall not be liable for decisions made solely on AI-generated outputs without human review.
- You are also responsible for monitoring call recordings and platform activity to ensure accuracy and compliance.
7. Data Retention and Use
Goje.ai may retain and use data you provide, or that is generated during service delivery, to deliver, improve, and maintain our services.
This includes analytics, reporting, and operational purposes. Personal data will not be used for AI model training unless anonymised or processed with the Client’s explicit written consent. You are responsible for ensuring that all necessary consents are obtained for any personal data you provide to us.
Goje.ai may retain or share your data with third parties for legal, regulatory, or legitimate business purposes.
All data provided by the Client, and any personal data processed in connection with the services, shall remain the property of the Client.
Goje.ai is granted a worldwide, non-exclusive, royalty-free licence to process such data for the purposes of providing, maintaining, and improving the services in accordance with these Terms.
Goje.ai may use data in aggregated and anonymised form for analytics, service improvement, and product development, provided that such data does not identify the Client or any individual.
All intellectual property rights in the Goje.ai platform, models, and underlying technology, including any improvements or enhancements, remain the exclusive property of Goje.ai.
8. Data Protection & Processing
Goje.ai processes personal data in connection with the services provided under these Terms. For applicable data protection laws, including the UK GDPR and Data Protection Act 2018:
- You act as the data controller.
- Goje.ai acts as the data processor.
Data Processing Details
- Nature: AI voice call handling and analytics.
- Duration: term of the agreement.
- Types of personal data: contact details, call recordings, metadata.
- Categories of data subjects: customers, prospects, employees.
How We Process Data
We will process personal data on your documented instructions and for the purpose of delivering our services, including call handling, reporting, analytics, and system functionality.
You are responsible for ensuring that you have a lawful basis for processing and have obtained all necessary consents where required.
Our Responsibilities
Goje.ai will:
- Implement appropriate technical and organisational measures to protect personal data, including access controls, encryption, and secure storage.
- Ensure that all personnel with access to personal data are subject to confidentiality obligations.
- Assist you in responding to data subject requests, including access, correction, deletion, and portability.
- Notify you without undue delay if we become aware of a personal data breach.
- Maintain records of processing activities where required.
The full terms governing our processing of personal data on your behalf, including sub-processors, security measures, and international transfer mechanisms, are set out in our Data Processing Agreement, which forms part of these Terms.
9. Limitations on Use
- Calls may only be made to individuals who have provided prior consent or with whom you have an established business relationship.
- Goje.ai may request evidence of consent or business relationships.
10. Caller ID and Compliance
- Accurately identify yourself on all outbound calls.
- Blocking or falsifying Caller ID is prohibited.
- Goje.ai may cooperate with law enforcement or regulators regarding suspected illegal or improper use.
11. Service Suspension & Termination
- Goje.ai may suspend or terminate your account immediately for prohibited or unlawful activities.
- Either party may terminate with 90 days’ notice.
- Breaches of these Terms may result in immediate termination.
- Outstanding fees remain payable upon termination.
12. Third-Party Services & Integrations
Goje.ai may rely on or integrate with third-party services and infrastructure (including telecommunications networks, APIs, and external platforms) to deliver its services. While we carefully select our providers and aim to ensure reliable performance, we do not have full control over these third-party services.
As a result, occasional disruptions, delays, or errors may occur. Goje.ai will use reasonable efforts to minimise the impact of such issues and restore services as quickly as possible. However, Goje.ai shall not be liable for failures beyond its reasonable control, provided that it has taken commercially reasonable steps to mitigate such failures. Use of certain features may also be subject to the terms of the relevant third-party providers.
13. Other Standard Terms
- User Accounts: Keep login details secure and provide accurate information.
- Data Ownership: Data generated or provided for service delivery will remain on the platform and will be retained by Goje.ai unless agreed otherwise. It remains your responsibility to export important data before the subscription ends.
- Confidentiality: Both parties agree to keep sensitive information private.
- Liability & Indemnity: Goje.ai is not liable for indirect, incidental, or consequential losses. Maximum liability for direct losses is limited to fees paid in the six (6) months preceding an incident. You agree to indemnify Goje.ai against third-party claims arising from your breach of these Terms or unlawful use of the services.
- Governing Law: These Terms are governed by the laws of England and Wales, with disputes subject to English courts.
- Force Majeure: Goje.ai shall not be liable for any delay or failure to perform its obligations due to events beyond its reasonable control, including but not limited to natural disasters, power or internet outages, telecommunications failures, labour disputes, or government actions.
